Challenge

The ArbZG serves to protect health and is mandatory law: maximum working hours, breaks, rest periods, and Sunday and public holiday rest may not be circumvented either by employment contract or by voluntary overtime. Since the case law of the CJEU and the BAG on working time recording, employers are also obliged to systematically record the start, end, and duration of daily working time. Violations are subject to fines and are regularly identified during inspections by the supervisory authorities.
