Challenge

Managers bear particular responsibility under the AGG: they decide on hiring, promotion, pay, and dismissal, and they are the first point of contact for complaints. Anyone who fails to design job advertisements, selection interviews, or performance appraisals free of discrimination exposes the company to compensation claims under Section 15 AGG and significant reputational damage. At the same time, the employer has a duty of protection and organization under Section 12 AGG, which has to reach day-to-day practice through its managers.
