Challenge

The EU MAR prohibits insider dealing and the unlawful disclosure of inside information, and this applies to everyone who has access to such information, not just board members. Violations are criminal offenses punishable by imprisonment of up to five years, in addition to fines, confiscation of profits, and public disclosure by BaFin. Employees in listed companies and at advisors and service providers must therefore know exactly what they may and may not do with sensitive information.
